Burglary

In Kentucky you do not have to physically break a barrier to be charged with burglary. If you simply enter a building or dwelling without permission with the intent of committing a crime, you can be charged with burglary. There are three “degrees” of burglary:

  • First Degree Burglary

    This is the most serious charge and is a Class B Felony. First Degree Burglary carries a potential sentence of 10 to 20 years.  This is the charge if you enter without permission and there are other factors at play – such as possession of a handgun, explosives, etc.

  • Second Degree Burglary

    This charge falls in the middle ground and is a Class C Felony. Second Degree Burglary carries a potential sentence of 5 to 10 years in prison. This is typically charged if you enter into someone’s house (or “dwelling”).  

  • Third Degree Burglary

    This is the least serious of the burglary charges and is a Class D Felony. Third Degree Burglary carries a potential sentence of 1 to 5 years in prison. This is typically charged if you enter into a building that is not a house.
